As a result of the boom that is acquiring the world of technologies, most visits to Internet pages are made through the search for Keywords without it being essential to enter the URL. In this way, the first results that appear will be the most relevant ones.

These keywords relate to trademark law, in particular to the word elements of trademarks, an issue that has been controversial in cases where those word elements of the selected mark are those of a competitor.

In this case, the Supreme Court Judgment of February 26, 2016 determined, that the use of keywords of the competitor does not infringe the trademark functions consisting of origin, advertising and investment. The Court bases its argument on the fact that there is no reference to the competitor’s trademark in the advertisement of the complained trademark.
