What is the tax law?
In order to understand what the tax law consists of, we must make a brief prior mention to the financial law, since the former is part of the latter. Financial law is a branch of public law that regulates the financial activity of the State and Public Administrations, that is, it is responsible for establishing the income and expenses that said individuals generate as a result of fulfilling their objectives.
Within the financial law we find the tax law, which regulates everything related to taxes. Specifically, the establishment and collection of the same and the legal relationships that arise from them.
A tribute, according to the RAE, is «the monetary obligation established by law, the amount of which is destined to the maintenance of public charges». In other words, taxes are legal obligations established by the State or the Autonomous Communities and imply that the individuals obliged to pay a certain amount of money to contribute to public expenditures. These obligations are established by public bodies without the intervention of individuals.
If we make a tax classification, we will see that there are three groups:
• The rates they are the monetary contributions that the beneficiaries of a specific administrative activity must make to benefit from it, such as court fees.
• The special contributions they are the liens that a private person must support when the value of a property that is on his property increases as a consequence of a public work, such as the paving of a street in which a person has properties.
• The taxes they are taxes that are required without the existence of a consideration, but are established in the face of a manifestation of economic capacity, such as, for example, the possession of a patrimony (property tax).
