What does marriage law consist of?
The matrimonial law is a matter that is regulated within the family law that, in turn, is part of civil law. The civil law is responsible for regulating personal and property relations between individuals or legal entities. On the other hand, the family law regulates the legal consequences that arise from the relationship of kinship, filiation and guardianship of minors or incapacitated persons.
The matrimonial law regulates the legal consequences that arise from marital relationships. Therefore, it is made up of the legal norms that regulate the institution of marriage.
Marriage is the institution that establishes a conjugal bond between two physical persons, converting them into spouses. This link implies the emergence of a series of rights and obligations between both people.
The matrimonial law also regulates the different economic-matrimonial regimes that can govern a marriage. The most common regimes included in our Civil Code are the community of acquisitions and the separation of assets. The first is applied by default in the case that the spouses do not establish an economic regime to regulate their marriage and implies that the gains obtained during the marriage will belong equally to both spouses. However, in the second each spouse is the exclusive owner of their assets and is free to manage them and dispose of them as they wish.
