What is the intellectual property right?
Commercial law is a special branch of private law that arose in the Middle Ages and has as its object to regulate the employer, the legal status of that employer and the peculiar business activity that develops in the market. This matter of the legal system is composed of different matters, among which is the right of intellectual property.
The right of intellectual property regulates the rights that correspond to authors (copyright) and other owners (artists or producers, for example) in relation to their creations. Therefore, the right of intellectual property includes both copyright and other related rights.
The subjects of copyright, which is the right of intellectual property par excellence, are the natural persons who create a literary, artistic or scientific work. According to article 1 of the Intellectual Property Law, the authors are holders of this right because they are the creators of the work and cannot renounce their status, as it is an inalienable and imprescriptible right.
On the other hand, there are holders of other intellectual property rights. These related rights correspond to the performers of the works, the producers and the broadcasters, among others.
In relation to the right of intellectual property, we must mention the Intellectual Property Registry. The registration of a work in this registry is not constitutive of rights, but it does serve as a method of proof that the rights that have been registered belong to the author.
There are national regulations on copyright, but the European Union regulations on this matter, known by the term «Copyright», are also applicable.
