What are the claims and civil liability?
The civil law is the branch of law responsible for establishing regulatory rules of relations between natural or legal persons, which can be both personal and patrimonial. Our Civil Code distinguishes contractual liability from extracontractual liability. The difference between both lies in the source of emergence of each of them.
Contractual civil liability, as its own name indicates, is that which arises from the damage caused by a breach of contract and is regulated in article 1101 of our Civil Code. On the other hand, extracontractual civil liability is that which arises when an injury is caused to a third party without a prior contractual link and is regulated in Article 1902 of the Civil Code.
