What is Family Rights?

Family rights are the set of rules that are located within the civil legal system and that regulate the family as a natural and social institution. The family is a very old social institution, but its conception has been changing over the years.

Family rights can be divided, mainly, into three aspects:

  • The marriage or matrimonial rights

    It gathers the legal norms that derive from the consecration of this institution.

  • Theaffiliation which can be matrimonial, extramarital or adoptive. This aspect also includes the regulation of parental authority.
  • The guardianship, which regulates the guardianship and custody of minors or incapacitated persons who are not subject to parental authority.

The Family rights are regulated in our Civil Code, which has undergone several modifications since its entry into force in 1889. In addition, there are also various special civil laws, both state and autonomous, which regulate specific aspects of family law.
