What does environmental law consist of?
Environmental law is an autonomous field of law that includes the rules and principles responsible for protecting the environment against the behavior of human beings that can damage it. Therefore, it regulates the relations between society and nature.
This branch of the legal system emerged in the late twentieth century in order to raise awareness of society about certain environmental disasters that occurred at the time. Its main objective is to ensure the environment to leave it free of contamination and conserve the resources it offers.
In the Spanish legal system, in addition to having specific environmental laws that regulate aspects such as water or biodiversity, among others, we find mentions to the environment in our Constitution and our Criminal Code.
The 1978 Constitution establishes in the first section of its Article 45 that «everyone has the right to enjoy an adequate environment for the development of people, as well as the duty to preserve it». Likewise, the second section adds that «public authorities shall ensure the rational use of all natural resources, in order to protect and improve the quality of life and to defend and restore the environment (…)». Finally, in the third section, article 45 contemplates the possibility of establishing criminal or administrative sanctions for those who fail to comply with these duties.
The Penal Code has a whole chapter (Chapter III of Title XVI) in charge of regulating «crimes against natural resources and the environment».
