This obligation that the documents must be submitted by electronic means has been enforced by different systems, in the Autonomous Communities the LexNet system will be applied, however, in the rest of the Peninsula, other systems will be used, such as Justiciazip in the case of the Basque Country.
This new rule is mandatory for Lawyers and Attorneys; but not only for them but, as provided in Article 8 of Law 18/2011, of July 5, it is also mandatory for judicial bodies and offices and Prosecutor’s Offices. This new provision has been embodied in the October 1, 2015 reform of the Organic Law of the Judiciary establishing «The Courts and Tribunals and the Prosecutor’s Offices are obliged to use any technical, electronic, computer and telematic means made available to them for the development of their activity and exercise of their functions, with the limitations on the use of such means established in Chapter I bis of this Title, Organic Law 15/1999, of December 13, on the Protection of Personal Data and other applicable laws«.
But in addition, Article 278 of the Civil Procedure Act imposes on legal entities the duty to intervene through electronic means with the Administration of Justice.

How will the procedural deadlines be calculated with the implementation of this automation service? The deadlines will be calculated as usual but taking into account that the lawyer has a maximum of 3 days to notify a decision (article 162.2 LEC). Thus, the notification of a procedural act occurs on the day following the date of its receipt in the organized electronic mailbox (STS of June 9, 2014).
