What is family law?
Family law is the set of norms that are located within the civil legal order and that regulate the family as a natural and social institution. The family is a very old social institution, but whose conception has been changing over the years.
The family law can be divided, fundamentally, in three aspects:
• The marriage or matrimonial law, which includes the legal rules that derive from the consecration of this institution.
• The filiation, which can be marital, extramarital or adoptive. In this aspect also enters the regulation of parental authority.
• The guardianship, which regulates the custody of minors or disabled persons who are not subject to parental authority.
Family law is regulated in our Civil Code, which has been undergoing changes since its entry into force in 1889. In addition, there are also several special civil laws, both state and autonomous, that regulate specific aspects of family law.
